The SEND Tribunal (formally the First-tier Tribunal, Special Educational Needs and Disability) is an independent body that hears appeals from parents and young people who disagree with decisions made by their Local Authority about special educational needs. How long does the SEND Tribunal process take?

From lodging your appeal to a final decision typically takes between 4 and 6 months, though this can vary. It's important to start gathering your evidence as early as possible.

Do I need a solicitor to appeal?

No — many parents represent themselves successfully. However, specialist legal support can be valuable if your case is complex or the LA is legally represented.

What if my appeal is unsuccessful?

You may be able to ask for the decision to be set aside if there was a procedural error, or appeal to the Upper Tribunal on a point of law. Seek specialist advice promptly.

Can I appeal more than one section of the EHCP?

Yes. You can appeal multiple grounds in a single appeal — for example, both the provision in Section F and the school named in Section I. Set out each ground separately on your appeal form.
